Terms of Service

1. Acceptance of Terms

By accessing or using ExamPull ("the Service"), operated by ExamPull ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or an in-app notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

ExamPull is an AI-powered platform that generates practice exam documents in PDF format. Users upload study materials, configure exam parameters, and receive professionally typeset practice exams and answer keys. The Service also provides AI-powered grading and feedback on submitted practice attempts.

The Service is intended for educational and practice purposes only. Exams generated by ExamPull are practice materials and should not be used as actual assessments, submitted as coursework, or represented as official examination documents.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent.

4. Subscriptions and Payments

ExamPull offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe.

• Subscription fees are charged in advance for each billing period.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are available within 7 days of the initial subscription purchase if no exams have been generated. Additional exam credits are non-refundable once purchased.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

• Use generated exams as actual assessments or submit them as your own original work
• Upload copyrighted materials without authorization from the copyright holder
• Upload materials containing illegal, harmful, or offensive content
• Attempt to reverse-engineer, copy, or redistribute the Service or its outputs at scale
• Create multiple accounts to circumvent usage limits or abuse free tier allowances
• Use automated tools to access the Service beyond the provided interface
• Share account credentials or transfer your subscription to another person

6. Intellectual Property

Your Content: You retain ownership of all materials you upload to the Service. By uploading, you grant us a limited license to process your materials solely for the purpose of generating exam content for you. We do not use your uploaded materials to train AI models.

Generated Content: Exam documents, answer keys, and feedback generated by the Service are provided for your personal educational use. You may download, print, and use them for your own study purposes. You may not sell, commercially distribute, or publish generated content.

Our Service: The ExamPull platform, including its design, code, AI models, and branding, is protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service.

7. AI-Generated Content Disclaimer

Exam content is generated using artificial intelligence and may contain errors, inaccuracies, or inappropriate material. While we strive for quality through automated quality assurance checks:

• We do not guarantee the accuracy, completeness, or correctness of any generated questions, answers, or feedback.
• AI-generated grading is approximate and should not be considered an authoritative assessment of your knowledge.
• Generated exams may not perfectly match the format, difficulty, or content of actual course exams.

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, ExamPull shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or academic outcomes, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior. Upon termination:

• Your access to the Service will be immediately revoked
• Your uploaded materials and generated exams will be deleted within 30 days
• Any remaining subscription period or unused credits will be forfeited

You may also delete your account at any time through the account settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
